Agreement to these Terms of Use

This is the official National Trust Picture Yourself in the Midlands website. By using or registering with this site, you agree to abide by these Terms of Use, the Privacy Policy and any other guidelines published on this site from time to time. Site users are also governed by this websites Terms and Conditions.

Whilst we welcome your participation with interactive features on this site, we will be moderating any comments or content that you chose to upload, submit or publish to this site. Due to the nature of our organisation we will be reactively moderating all comments or content uploaded to this site. This means that once your content has been published if another user reports your content as not in accordance with these Terms of Use we can remove any of your content without further notice to you.

By choosing to participate in our interactive features you agree to abide by these terms of use and the following Participants' Rules.

Participants' Rules

You must follow these rules when participating in any interactive feature on The National Trust Picture Yourself in the Midlands website:

  • Your contributions must be civil, polite and tasteful. This creates an enjoyable space for all users.
  • No disruptive, offensive or abusive behaviour, unlawful or objectionable content. This includes any material which might be defamatory, offensive, infringing, obscene, lewd, pornographic, violent, abusive, insulting, threatening, harassing, discriminatory, blasphemous, indecent or otherwise unlawful or objectionable.
  • No spamming or repetition.
  • No advertising, marketing or other commercial messages or content.
  • No impersonation of other users or public figures.
  • No inappropriate user names. This includes anything vulgar or offensive.
  • You may not refer to other websites, or post urls.
  • You may not use multiple logins to try to disrupt the community or annoy other users.
  • Please be patient as users of all ages, backgrounds and abilities may be taking part in the community.
  • Use plain English and not slang in your posts.
  • No personal information or contact details (for example yours or anyone else's phone number, email address, or home address) are to be published on this site.
  • We do not tolerate plagiarism. If the photo is not yours please do not publish it on this site.
  • By uploading your photos to be published to this site you acknowledge that this work is your own and has not been published anywhere else.

The views expressed in any published content or comment are those of members of the public and are not necessarily those of The National Trust.

If you breach these rules, you will be sent an e-mail which informs you why your contribution was reported as inappropriate and has been edited or removed. This mail may include a warning that continuing to break the rules may result in action being taken against your account.

If the breach is serious or persistent, we may suspend or block your account without warning.

The National Trust reserves the right to delete any contribution, or take action against any account, at any time, for any reason.

Ownership

This site, including its trade marks, logos, design, text and graphics, is owned by and remains the property of The National Trust.

Use of materials

You may not copy, transmit, store or disseminate any element of this site, unless we have clearly indicated. You may not alter, modify, adapt, reverse engineer, disassemble or create derivative works of any software contained on this site.

Registration and passwords

If you register with us and are asked to provide a password, you agree:

  • to keep your password secure and confidential and not allow anyone else to use your email address or password to access this site
  • not to do anything which would assist anyone who is not a registered user to gain access to any registration area of this site
  • not to create additional registration accounts for the purpose of abusing the functionality of the site, or other users, or to seek to pass yourself off as another user.

Your contributions

All images entered must be taken outdoors within National Trust owned and managed landscapes including gardens, parklands and countryside sites in the Midlands. Locations must be credited. The materials you submit must be your own original works.

Entrants will retain copyright and moral rights in their submitted images however, by entering, all entrants grant the National Trust, non-exclusive rights to use the images to promote the competition the images were submitted to.

The National Trust will contact image owners before using any images, to seek permission where it is deemed necessary for any other use. We will not use any images without the owners consent.

By submitting your contribution you acknowledge and confirm that all models used in your contribution have provided consent to have their images published on the www.pictureyourself.org.uk website.

Responsibility for use

To the extent permitted at law, The National Trust does not accept responsibility or liability for any loss or damage that may occur in connection with this site, including any interruption or delays.

To the extent permitted at law, we do not accept any responsibility or liability for any infection by virus or other contamination resulting from your use of this site.

All software provided by third parties is the sole responsibility of that third party.

The National Trust is not responsible for the content of any third party sites linked to or from this site.

IF YOU ARE UNDER 18 – Please get your parent's or guardian's consent before using any interactive features of this site. Never reveal any personal information about yourself or anyone else (e.g. your telephone number, home address or email address).

Unlawful use

You may only use this site for lawful purposes and you may not inhibit the use and enjoyment of this site by any third party. You agree to abide by all applicable laws, regulations and codes of conduct and to be solely responsible for all things arising from your use of this site. You may not submit, publish, post, distribute or transmit any defamatory, offensive, infringing, obscene, lewd, pornographic, violent, abusive, insulting, threatening, harassing, discriminatory, blasphemous, indecent or otherwise unlawful or objectionable material or information.

Actions for unauthorised use

If The National Trust considers, in its sole discretion, that you have breached these terms of use or other users have reported that you have demonstrated inappropriate conduct in your use of this site, we reserve the right to: remove any material which you have posted to this site; discontinue your registration to this site or any related service; and/or take other measures, including terminating, suspending or restricting your use of this site. Any action that we take is without prejudice to any of our accrued rights.

Governing law

These terms of use shall be governed by and construed in accordance with the law of England, Wales and Northern Ireland and you agree to submit to the exclusive jurisdiction of the English, Welsh and Northern Irish courts.

Terms and Conditions

Competition

  1. Only images of National Trust locations in the Midlands will be considered in this competition
  2. The competition is not open to employees, volunteers or their families of The National Trust, or agents of The National Trust.
  3. No cash alternative or refund can be given in place of the prizes.
  4. Entries must be uploaded to www.pictureyourself.org.uk by becoming a member of the site and accepting the Terms of Use.
  5. Entries that exceed the size limit of 10MB will not be published on this site or accepted as an entry. Please ensure that your entries are kept below this size.
  6. We regret that postal entrants will not be accepted
  7. Entrants must have parental consent before entering the competition.
  8. Only one entry of the same photograph is permitted per person. No duplication of the entry is allowed and will be considered void. Though entrants are allowed to submit multiple entries per month providing the content of the photograph differs from previous entries.
  9. The competition form is valid only on completion of name and address details and acceptance of these Terms and Conditions.
  10. The closing date for entries will be 9 September 2011. The National Trust reserves the right to amend the period of this competition without prior notification
  11. The winners will be selected by our panel of judges and will be notified by email, post or telephone.
  12. The winning photographs will be published on this site after the winners have been notified.
  13. The judges' decision is final and no correspondence will be entered into.
  14. The National Trust will not be responsible for any transport costs incurred in the fulfilment of the prize.
